Methodology
An effective forensic defense requires more than simply disputing an allegation. The Two Prong Test examines the matter from two essential directions, focusing on evidence supporting the accused while also evaluating the credibility and reliability of the allegations.
Psychological testing and, when appropriate, psychosexual testing conducted by qualified evaluators can contribute objective information to the defense. Testing should follow applicable professional guidelines and be considered within the broader context of the evidence.
The second component examines factors that may affect the reliability of allegations or investigative conclusions. These may include coaching, confirmatory bias, source misattribution, investigative methodology, and relevant psychological factors involving accusers or investigators.
Fee Structure
Private counsel and litigants may retain Mr. Tong through a standard consulting retainer. Fees for case review, written reports, depositions, consultations, and trial testimony are determined by the nature and scope of the engagement.
